Unpaid Wage Claims
An employee who:
1. believes his/her employer has violated the law and
2. has not been paid for work performed
may have a claim for unpaid wages. Employees who qualify to use the services of the California Division of Labor Standards should file a claim with it before filing a claim in Small Claims Court.
The Division office provides information about labor laws and alternative resources if you do not qualify to use its services. The telephone can be obtained from the local phone directory. The number usually has a 24 hour recording that provides information on how to file a claim. You may leave your name, address and telephone number on the recording device and a claim form will be mailed to you. If your questions are not answered by the recording you may remain on the telephone line for personal assistance. Assistance is provided Monday through Friday usually from 8:00 am to 4:45 p.m.
